WHEN the hearings of the two Court actions brought by the Central Islamic Organisation of Guyana against the Shaheed Boys and Girls Orphanages and the Trustees of the B.G. United Sad’r Islamic Anjuman continue today, the judge is expected to look into the operations of the Interim Management Committee (IMC).

One of the defendants is alleging in affidavit that the Interim Management Committee, which was appointed to run the Shaheed Boys and Girls Orphanages and the Anjuman, is not acting in the best interest of the organisations.

Upon hearing attorneys-at-law for the plaintiff and for the defendants, it was by consent ordered that Shairaz Usman Ali, Moenudin Mohamed Mc Doom Jnr., Shalimar Ali Hack, Raheema Rahaman, and Yacoob Hussain be the persons named to the Interim Management Committee to manage the affairs of Shaheed Boys and Girls Orphanages.

And it was also by consent ordered that the signatories to the Guyana Bank for Trade and Industry Account No. 0101196543 shall be Mr. Rafiq Khan, attorney-at-law alone, or Mr. Rafiq Khan and any other member of the Interim Management Committee nominated by the other five members.

And it was further ordered that all the payments to be drawn on Account No. 0101196543 shall be on the written instruction of the Interim Management Committee.

The Interim Management Committee was appointed by Chief Justice Carl Singh on March 31, 2003 to run the affairs of the Shaheed Boys and Girls Orphanages and the affairs of the Guyana Sad’r Islamic Anjuman.

The actions were served on one defendant Raheema Rahaman and she has filed an affidavit in answer together with other affidavits in support.

The plaintiffs in the actions are claiming, among other things, that the defendants have infringed the laws and rules governing the orphanage.

They are also asking for a declaration to the effect that the defendants who hold themselves out as trustees have not been lawfully elected as trustees.

They are also asking that the Shaheed Boys and Girls Orphanages should produce accounts and audited statements and that new trustees be appointed.

Since the making of the order in March 2003, the Orphanages and the Anjuman have been under the control of the Interim Management Committee.

The defendant Raheema Rahaman, in her affidavit in answer, is alleging that the action by the plaintiff is bad in law and that it is an attempt by the Central Islamic Organisation of Guyana to take over the control and assets of the Anjuman and the Orphanages.

Appearing for the plaintiff are Mr. Rex Mc Kay, Senior Counsel; Mr. Moen Mc Doom, Sr., Senior Counsel, and Ms Jamela Ali.

Representing the defendant is Mr. K. A. Juman-Yassin.
