MURMURINGS from within yesterday caused Magistrate Chandra Sohan to threaten that he would clear the courtroom for the continuation of the Mark Benschop treason case.

But the magistrate’s declaration that the place is not a church met with stamping of feet and screaming and he took an abrupt adjournment after another verbal exchange between counsels on opposite sides.

Mr. Sohan summoned all the lawyers to his chambers and, after a 20 minutes caucus, announced that the differences had been resolved.

The proceedings against political activist Mark Benschop continued with another Presidential Guard, the seventh witness to testify, being cross-examined by lead Counsel for the Defence, Mr. Basil Williams.

Constable Rabindranauth Mohal followed Constable Ramesh Itwaru and was being grilled by Wlliams when Mr. Anil Nandalall, for the Prosecution, objected to the questions being asked the witness.

Williams complained that the other side had been prompting throughout the morning and urged the magistrate to take action.

Nandalall was identified by Special Prosecutor Sanjeev Datadin since the magistrate said only two counsel from each side would be allowed to deal with witnesses.

Mr. Dharshan Ramdhani is also associated with Datadin at the preliminary inquiry into the joint charge against Benschop and Philip Bynoe, for whom an arrest warrant is out.

The pre-trial hearing resumes today.
