Committee cites seven TV stations for infringements

THE Advisory Committee on Broadcasting (ACB) has cited seven television stations for breaches of the terms of their broadcast licences and has recommended that serious warnings be issued against several of them.

The three-member body was established on November 7 last year under regulations made under the Post and Telegraph Act Chapter 47:01 and has tendered to Prime Minister Sam Hinds its advice and recommendations regarding cases of violation and infringement of the terms and conditions of the television broadcasting station licences by the seven stations.

Those named in the ACB's first such action are Channels Six, Seven, Nine, 11, 14, 18 and 28.

A statement from the Office of the Prime Minister yesterday said the ACB's advice and recommendations "relate to violations and infringements of their licence conditions between 17th May and 21st, June, 2002."

It noted that the Memorandum of Understanding between President Bharrat Jagdeo and Opposition Leader, Mr. Desmond Hoyte, dated November 7, 2001 requires the Prime Minister to act in accordance with the advice and recommendations of the ACB.

Extracts from the ACB advice to the Prime Minister were released in the statement.

The committee found that VCT 28 on May 17, 2002, on its `EVENING NEWS', "Mr. Jerome Khan attacks the IDB (Inter-American Development Bank) making unsubstantiated allegations and with doubtful accuracy."

It said this infringes Condition (b) of the licence and recommended that the licensee be advised or strongly advised to observe more carefully the relevant provisions.

On MTV 14 on June 9 last, on the programme `SANATAN DHARMA', "Mr. Harricharran speaks on Hinduism and Race. Makes demeaning remarks about Hinduism. By innuendos and implications makes racist statements. Infringes Conditions (a) and (d) of the licence.

"Recommended Penalty: Warning or serious warning: The ACB takes a serious view of the contravention and the licensee is warned against further contraventions."

According to the ACB, on WRHM 7 on June 11, on CAPITOL NEWS, "Mr. Rawle Collins, Announcer, carries news item of Cambridge, featuring his mother. Mother dilates on Police action in a partisan fashion without balance; the Police position that Cambridge had a motive to murder the Police Sergeant not mentioned. Infringes Condition (b) of the licence.

"Recommended Penalty: Warning or serious warning: The ACB takes a serious view of the contravention and the licensee is warned against further contraventions."

(The Cambridge referred to is Compton Cambridge, a wanted man who Police said was shot dead in a confrontation with a Police patrol.)

Extract 1V reads: "NBTV 9 - JUNE 13, 2002/ AFRICAN PERSPECTIVE/ 9:00P.M.Mr. Ogunseye stereotypes Black People as using violence against Black people. Infringement (a). Extra judicial killings and intimidating and punishing African communities part of the PPP's political agenda.. Infringement of Condition (a) of the licence.

"Stereotypes Indo-Guyanese and accuses Indo-Guyanese of not having any concern to bring such a killing to an end. Infringement of Condition (a) of the Licence.

"In the call-in, which followed, callers consistently advocated murder of Policemen and their families. Infringement of Condition (a) of the Licence.

"Recommended Penalty: Warning or serious warning: The ACB takes a serious view of the contravention and the licensee is warned against further contraventions. Any further infringement of this magnitude should attract: Suspension or revocation of licence: In very serious cases, the ACB may recommend the suspension of a licence (up to 30 days), or make recommendation to have the licence revoked."

The ACB found that on June 17 on the Sunrise Show on CNS 6, a woman "reported that someone told her that President Jagdeo advocated the killing of Mr. (C.N.) Sharma which statement Mr. Sharma reiterated, treating it as fact."

It said this was an infringement of Condition (a) of the Licence and its recommended penalty is "Warning or serious warning: The ACB takes a serious view of the contravention and the licensee is warned against further contraventions. Any further infringement of this magnitude should attract: Suspension or revocation of licence: In very serious cases, the ACB may recommend the suspension of a licence (up to 30 days), or make recommendation to have the licence revoked."

Extract V1 reads: "NTN 18/ JUNE 17, 2002/ SQUARE TALK/ 9:00 P.M.

Mr. Kwame McKoy implies that the PNC party was involved in recapping the plunder from recent robberies. Infringement of Conditions (a) and (b) of the Licence.

"Recommended Penalty: Warning or serious warning: The ACB takes a serious view of the contravention and the licensee is warned against further contraventions. Any further infringement of this magnitude should attract: Suspension or revocation of licence: In very serious cases, the ACB may recommend the suspension of a licence (up to 30 days), or make recommendation to have the licence revoked."

The ACB said that GTV 11 on June 20 aired the movie `BRIDGES OF MADISON COUNTY' at 2:30 p.m.

It noted that that the movie has sexual content, adding "Pornography at 2:30 p.m. with young listenership."

Its recommended penalty: "Advice or strong advice: The licensee is advised or strongly advised to observe more carefully the relevant provisions."

Extract V111 reads: "NBTV 9/ JUNE 21, 2002/ GUYANA THE WAY FORWARD/ 9:00 P.M.

"Lorri Alexander reads pamphlets inducing disaffection in NCO ranks and inciting racial hatred. Infringement of Condition (a) of the Licence.

"Recommended Penalty: Warning or serious warning: The ACB takes a serious view of the contravention and the licensee is warned against further contraventions. Any further infringement of this magnitude should attract: Suspension or revocation of licence: In very serious cases, the ACB may recommend the suspension of a licence (up to 30 days), or make recommendation to have the licence revoked."

The statement said Prime Minister Hinds "is implementing the advice of the ACB."
