Discipline over Magistrates lies with the Judicial Service Commission

The Cabinet Secretary's expressed certainty that magistrates are involved in the perceived corruption in the magistry is out of place for a high executive officer of the political directorate.

Many are amused at the Cabinet Secretary's recent discovery of corruption in the governmental service, always among the gatekeepers. While giving those responsible for the Cane Grove disaster a kiss on the wrist, the Cabinet Secretary has violated the constitution in order to find balance.

Under the Constitution Article 199, the power of discipline over magistrates lies with the Judicial Service Commission. It has been said that the Commission is yet to be appointed.

Under the revised Consti-tution, the National Assembly plays a part in the appointment of a member of the Judicial Service Commission. The Assembly is not meeting and from all appearances the Cabinet has taken responcibility for the discipline of magistrates.

It seems that the same meeting of Cabinet, which gave those responsible for the Cane Grove disaster a kiss on the wrist, has decided to find magistrates guilty with a promised trial.
