Court to rule on Yasseen, Thomas appeal on Dec. 20

An appeal by condemned murderers, Noel Thomas and Abdool Saleem Yasseen, will be decided on December 20, when the Full Court will rule on the matter brought by lawyers for the two men. The ruling, against which Thomas and Yasseen are appealing, was delivered by Justice Winston Moore on October 18.

The judge had refused an application by Stephen Fraser, lead attorney for the two men to have a stay of execution he had granted continued, ruling that he failed to find merit in any of the arguments advanced by their lawyers.

He had, however, granted a stay of execution to facilitate their attorneys filing an appeal against the Full Court, an exercise that concluded on December 1.

During the time of the appeal, Fraser and Attorney General, Charles Ramson, who is appearing on his own behalf and that of Director of Prisons, Dale Erskine, had made submissions before a Full Court panel comprised of Chief Justice Desiree Bernard, Justice Deonarine Biscessar and B.S. Roy.

Even if the December 20, ruling is not in their favour, Thomas and Yasseen still have the option of taking their case to the Court of Appeal.
